Rights of Parents and Senior Citizens.

Socio-legal research

Six students (Tammana, Janvi, Sheetal, Eesha, Shubham, Vaibhav) from BBA LLB of Alliance School of Law, Alliance University, Bengaluru went to the “Asharya old age home located at Senior citizen center, Sai Prashant layout, Bengaluru Karnataka- 562106 on behalf of Alliance Legal Service Centre (AULSC)

Students of Alliance school of law discussed with senior citizens and brought awareness regarding their rights enshrined in Constitution of India and other relevant legislations. They had first discussed about right for the senior citizen as per the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, from the application of Act to the necessary provisions like

  • Senior citizen who is unable to maintain themselves has the right to apply maintenance tribunal seeking a monthly allowance from their children or heirs.
  • If they are incapable of filling the application on his own, they may authorize any other person or registered Voluntary Organization to apply on their behalf. The Maintenance Tribunal, on its own also initiates the process for maintenance.
  • Students also talked about the State government role to maintain senior citizens, by setup a maintenance tribunal in every subdivision to decide the level of maintenance and also students resolved some queries of senior citizens regarding how they can claim the monthly maintenance.
  • Students also discussed various provisions of maintenance provided under Code of Criminal Procedure, 1973and also discussed about the offence and penalties of nonpayment of maintenance and monthly allowance.

Students spent some time understanding the needs of the senior citizens. The project sensitized the students about society’s burning issues and gave them the opportunity to guide people of their legal rights.
